The Ministry of Labour, Immigration and Population publishes a new model agreement.

Notification 140/2017 was published on 28 August 2017 by the Ministry of Labour (the Ministry) together with a revision of the Collateral Agreement (SEC 2017), which supersedes and supersedes the current Collateral Document, the SEC 2015. Companies with more than five staff members must use the SEC 2017 and notify the concluded agreements to the employment office of the respective municipality.

Contracts of work concluded before the new notification shall continue to be in force until their expiration. SEC 2017 () is similar in many ways to SEC 2015, but the new templates contain a number of noteworthy features. Particularly important is clause 5(d), which provides that the length of tenure of the worker from the date of the employee's entry into the company, including all successive periods of tenure with the company, shall be calculated by the company.

The new system means that the compensation due to the worker at the end of the work relationship is based on the full working time and not only on the duration of the last fixed-term work relationship. In addition, provision 21(b) points out that in accordance with Myanmar legislation, job related policies and procedures are regarded as part of the Understanding.

Term 21(c) provides for the possibility of agreeing changes to the submission if more than 50% of co-workers do so. SEC 2017 does not develop a procedure or methodology to obtain such approval, nor a procedure to sustain the necessary degree of approval for new personnel in a company.

SEC 2017, like its forerunner, is largely in compliance with the law with regard to dismissals and dismissals. Circumstances that actually have a legal foundation mirror the legal requirements and are not reviewed as duly prepared contract term with single staff members. In addition, the annex must contain the requirements that they require of workers, together with the various layers of measures to be taken in the case of malpractice, i.e. Annex (A): petty crimes and measures taken by the employer; and Annex (B): serious crimes and measures taken by the employer. and Annex (A): serious crimes and measures taken by the employee.

We are working with the Township Labor Offices to better understanding the modified conditions of the SEC 2017 and to determining to what degree the SEC 2017 can be modified.
