Myanmar: law on film
The law is known as the law on films. a) Image is the presentation of a still image, a moved image or image and a soundtrack by any cinema recording technique and the equipment used to display it; b) Image is fiction movie, full-length movie, archive movie, newscape, animation movie or educational movie recorded and made as a theatrical movie; c) Image censorship certification is a certification granted by the Authority for the cinematography and permits the publication of a cinematic movie under this Act;
a) Cinematographic licence means a licence granted under this Act to operate any kind of film industry; (e) Cinemas include a movie theater premises, facilities or other location for the display of films; (f) Cinemas are licensed to the cinemas; (g) Evaluation Committee means the judging committee established under this Act to raise the standards of films in Myanmar; companies within the meaning of this Act.
a) to modernise and improve the standards of Myanmar Movie Pictures Business; b) to bring about the creation of Myanmar Movies that will benefit the overall evolution of the state and the conservation of Myanmar's rich historical heritages; and c) to encourage the creation of Myanmar movies that help unite ethnic groups and preserve the patriotic spirit; d) to encourage the creation of prominent filmmakers and performers; e) to ban decades-old movies that subvert Myanmar's civilization and Myanmar's tradition and ritual.
a) making cinema films; (b) making cinema films; (c) development and print of cinema films; (d) audio recordings of cinema films; (e) cutting cinema films; (f) distributing cinema films; (g) import of cinema films; (h) export of cinema films.
Myanmar Motion Picture Business can issue or decline the Motion Picture Business License after checking that the requests comply with the terms. Ministry of Information determines the duration of the Motion Picture Business License, the Motion Picture Business License, the delay charge and the prolongation of the duration.
a) A subject wishing to renew the term of the Motion Picture Business License must be valid for Myanmar Motion Picture Enterprise upon expiration of its validity under the provisions; b) Myanmar Motion Picture Enterprise may renew the term after the specified charge has been made. a) determines the requirements to be met by the Motion Picture Business License owner; b) may fines the Motion Picture Business License owner a penalty of at least 5,000 to a total of at most 50,000 000 kilyats for violating any of the requirements of subparagraph (a).
It may also terminate the Motion Picture Business License. This Motion Picture Business License expires upon expiration of the term of office or upon cancellation or transfer by the owner of the Motion Picture Business License. The Motion Picture Censor Board consists of the following persons: The Motion Picture Censor Board may (b) establish the term of office of the Motion Picture Censor Board; (c) reconstitute the Motion Picture Censor Board as required.
Non-State members of the Board are eligible for the compensation required by the Ministry of Information. a) check the fiction movie entered before shooting begins; b) approve or reject the shooting of the fiction movie; c) issue the necessary permission or deny the shooting once the fiction movie has been made.
a) may allow the exposition to the general or reserved audiences; b) may allow the Myanmar movie to be publicly displayed after the removal and alteration of the part not fit for the general exposition and may keep or demolish this Excited Part; c) may allow the exposition of the exported movie to the general public after the part not fit for the general exposition has been removed and may keep or demolish this Exc Excited Part;
can ( ) ban the publication of the Myanmar cinema movie and may keep or demolish it; (e) ban the publication of the movie and arrange for it to be restored or stored; (f) grant the censorship certificate against remuneration of the required charge if the movie is approved for publication.
a) The MOPC certified product provided by the MPCB will be available throughout Myanmar for the specified time; b) The MPCC certified product provided by the MPCB will be distributed with the movie. a) Upon expiration of the term of office of the MOPC, a subject wishing to renew the term of office may request the Censor Board in accordance with the provisions; b) The MPC may renew the term of office of this MOPC after having arranged for the required charge to be paid.
They can ask the censor board to check the exhibit in front of themselves of any movie. a) to cancel a Myanmar Movie Censor Certificate if there is a good cause; (i) to keep or demolish the Myanmar Movie; (ii) to return or keep the importation.
In the event that a subject is not satisfied with the Motion Picture Censor Board's judgment pursuant to § 13 (b), (c), (d), (e) or § 17 (b), the Motion Picture Censor Board shall lodge a complaint with the Ministry of Information.
a) establishes the evaluation committee for upgrading the standards of Myanmar's films, composed of the following individuals: This is necessary and may specify the term of office of the Audit Committee. Non-state members of the Audit Committee are eligible for the compensation required by the Ministry of Information. It may decide on the type of film awards to be reviewed and evaluated from case to case by the Examining Board and, if necessary, make changes.
a) to review and evaluate all Myanmar films shown during a given year to determine whether or not they comply with the policies established to allow the awarding of prizes for Myanmar's exceptional films; b) to commend to the Ministry of Information a nomination table that deserves to be reviewed and evaluated under letter a) in accordance with the categories of exceptional film prizes required by the Ministry of Information.
If necessary, the review board may make a copy of the Myanmar movie that has been reviewed and evaluated. Anyone wishing to purchase a Cinema Room license must contact Myanmar motion image enterprises in accordance with the terms and conditions. a) to examine the cinema auditorium licence for compliance with the provisions; (b) to obtain the comments of the competent governmental authorities and organisations before issuing the cinema auditorium licence; (c) to issue the cinema auditorium licence if it complies with the provisions.
Myanmar Motion Picture Enterprise, with the consent of the Ministry of Information, determines the duration of the auditorium license, the auditorium license charge, the delay charge and the prolongation of the duration. a) Upon expiration of the Cinema Room License term, a subject wishing to renew the term may request in accordance with the terms; b) The Myanmar Motion Picture Enterprise may renew the term of the Cinema Room License upon payment of the required royalties.
a) establishes the requirements to be met by the cinema licence holders; b) may impose a penalty of at least 1000 to at most 10000 000k yats on the cinema licence holders who violate any of the requirements of subsection (a).
It may also withdraw the cinema hall licence. Cinema auditorium licences expire upon expiration of the term of office or upon cancellation or transfer by the cinema auditorium licensee. Anyone who is unhappy with the Motion Picture Censor Board or Myanmar Motion Picture Enterprises judgment or order may lodge an complaint with the Department of Information within 30 calendar working day of the date of such judgment or order.
In relation to the complaint, the Ministry of Information may uphold, repeal or review the ruling or order of the Censorship Authority or the Myanmar motion image agency or order a re-examination or review. a) the operation of any kind of movie shops referred to in Section 4 without a movie license; b) the issue of a movie without a movie censorship certificate.
A person showing a film without a cinema licence will be fined up to 6 month in prison or up to 50,000 kyat or both and, in the case of a continued crime, an additional 500 kyat for every additional one.
a) A foreign diplomatic organization or a United Nations organization wishing to make an Imported Cinema movie available to the general public must present it to the motion-picture censor board for consideration; (i) authorize a show to the general public if it considers it appropriate; (ii) cut out the part unfit for a general show and keep the cut out part abroad before the movie is returned; (iii) allow an exhibit only to a reserved audiences on the facilities of the foreign diplomatic organization or organization of the United Nations concerned.
Myanmar Motion Picture Enterprises is exempt from payment of tax and fees for the Motion Picture Business License, Cinema Hall License and Motion Picture Censorship. Violations under this law are required as criminal acts identifiable by the Myanmar police. b ) to pay the expenses of the Censorship Commission for Cinematographic Works and the Evaluation Board.
a) The regulations, orders and guidelines adopted under the Union of Myanmar Motion Picture Law,4962 may remain in force unless they conflict with the terms of this Act; b) The Motion Picture Censor Board, Appellate Authority Board and Licensing Authority established under the Union of Myanmar Motion Picture Law, 1962 may remain in force before the Motion Picture Censor Board and Assessment Board may be established under this Act;
c) The license, certificate for cinematographic works and filmmaking businesses registered under the Union of Myanmar motion-painting law, 1962, shall be in force until the date of expiration of their term of office. a) The Ministry of Information may, with the consent of the Government, adopt the necessary regulations and processes; b) The Ministry of Information, Myanmar motion image censor enterprise, board or assessment board may adopt the necessary regulations and guidelines.
In 1962, the Union of Myanmar Motion Picture Law is abolished.
